TERMS AND CONDITIONS
1. GENERAL
Unless we tell you otherwise, when you make a booking your
contract will be with Villas of Morocco Limited, a company
registered in England and Wales under Company number 4483177
whose registered office is at 25 New Street Square, London,
EC4A 3LN. However, given we are not a tour operator, you
may have to contract directly with third parties in respect
of some aspects of your holidays.
2. BOOKING PROCEDURE AND FORMATION
OF CONTRACT Before making a booking, you must contact
us to obtain confirmation that your chosen property is available
for the dates required. Please note that availability and
rates may vary but that you will be given the up to date
rate of your chosen villa before you book. Once you have
selected your villa (on www.villasofmorocco.com or in our
brochure), you should contact our Reservations Office by
phone on
+ 44 207 823 22 55 or one of our toll free numbers available
in our brochure or Website, email (reservations@villasofmorocco.com)
or fax on +44 207 823 22 82 to indicate your interest in
booking a villa with us. Please note that if you email or
fax us, you should provide a contact telephone number so
that we can contact you. One of our Advisors will phone
you to discuss your specific requirements and collect the
information needed in order to process your booking. Any
personal data you give to us will be processed in accordance
with our Privacy Policy, which is available on our website,
it can also be sent to you if you email us at privacy@villasofmorocco.com.
We will then e-mail or fax you an Invoice containing the
details of your booking. Once you have checked that you
are satisfied with the details contained in the Invoice
and that you have read these terms and conditions, you need
to arrange for payment in accordance with clause 3 below.
Our rates are expressed in US$. All payments need to be
made in the US$ by bank transfer (the account will show
on your invoice), banker's draft of cheque (please make
cheques payable to Villas of Morocco Ltd). We also accept
payment in UK sterling by credit cards or cheque. We accept
Visa, Mastercard, American Express, Delta, Switch or Solo.
By arranging payment, you confirm that you have read and
agree to be bound by these terms and conditions, which are
either sent to you alongside with your invoice, or if you
are making a booking by telephone, which are available on
the website. Your booking will only be confirmed and effective
when we issue a Booking Confirmation upon securing payment
of the deposit (or full price if the booking is made less
than 6 weeks before departure). Bookings cannot be accepted
from persons under 18 years of age at the time of booking.
We reserve the right to refuse a booking without giving
any reason.
3. PAYMENT for bookings made more than six (6) weeks
prior to departure, a non-refundable deposit of 30% is requested
to secure the booking (except peak periods where a 50% deposit
will be requested), and the outstanding balance is requested
no later than six (6) weeks prior to departure. There is
no reservation system to hold a villa. To secure bookings,
the deposit is payable immediately. If you pay by bank transfer,
banker's draft or cheque, your funds must be received within
72 hours of the date of the Invoice unless you have sent
us, within that 72 hour period, an email or fax confirming
your acceptance of these Terms and Conditions and a proof
that you have arranged payment, in which case we will give
you an extra 72 hours for us to receive the deposit. This
extension will only be valid if we send back a Booking Option
Extension Confirmation to you by email or fax. The balance
must be paid no later than six (6) weeks before departure.
For bookings made less than 6 weeks prior to departure,
the full amount (as per our Invoice) is payable immediately
and must be received within 72 hours of the date of the
Invoice unless you have sent us, a confirmation as above
in which case we will give you an extra 72 hours to pay
the full cost. This extension will only be valid if we send
back a Booking Option Extension Confirmation to you by email
or fax. Regardless of whether the booking is made more or
less than 6 weeks before departure, failure to pay the balance
on time may, at our discretion, constitute a cancellation
and cancellation charges will become payable in accordance
with clause 6 below. You are responsible for payment of
the full cost and the compliance of members of your party
with these conditions. To the extent this is possible, all
bookings need to include arrangements on additional services
(catering, transport, extra staff, personal and corporate
events, and other additional services ("the Additional
Services")) you wish to have, as well as the price
of those Additional Services. Additional Services require
a deposit of 30% at the time of the booking, and the balance
6 weeks prior to departure (or 100% if we accept your booking
and it is made less than 6 weeks prior to departure). To
the extent this is possible, all booking of Additional Services
should be made at least six (6) weeks in advance and if
you have booked a villa, we reserve the right to refuse
to provide Additional Services if you decided to book the
Additional Services less than six (6) weeks prior to the
start of your stay.
4. RATES Villa rates include
the accommodation in the property on an exclusive basis
and are subject to owners' terms and conditions, available
on request. Rates will usually include all taxes and charges,
electricity, and heating, and daily cleaning service, however
this will vary from one villa to the other. Not included
in villa rates: cost of obtaining passports or visas, meals,
transfers, beverages, extra staff, transport, including
transport of staff, gratuities for staff, personal expenses
such as communication charges, travel insurance, excess
baggage charges, airfares, airport taxes, concierge activities,
shopping service and food deposit, massage services. All
extra services are normally charged in advance at the time
of your booking. Services booked at the villa will be charged
in UK sterling to a credit card that you will need to provide
us at the time of arrival. Rates are subject to change without
notice. A Security Deposit of 10% of your total bill (including
all services) is usually required to cover the cost of any
damage or breakages, as well as a credit card number to
cover for any damage in excess of the security deposit and
the cost of any additional services provided at the villa.
For some properties with very valuable items, we will also
request a cheque to guarantee any damage to the property.
This cheque will be kept in a safe and returned to you upon
your departure. Should this cheque be required, and you
fail to provide the cheque at your arrival, we reserve the
right to refuse your access to the property. The Security
Deposit will be returned to you within two weeks of your
return less any costs. Delays may be caused while we are
waiting to receive any bills from Morocco.
5. ALTERATIONS OR CANCELLATION BY
US In the unlikely event that it is necessary for us
to make an alteration to or cancel the villa specified in
the confirmation invoice, we will inform you as soon as
possible and, if requested, we will try to arrange alternate
holiday accommodation of a similar type and standard and
in a similar location as that originally requested. If the
alternative holiday accommodation is not acceptable, we
will refund in full all monies paid and shall be under no
other liability.
6. CANCELLATION BY YOU any cancellation
by you must be in writing addressed to us at Flat 1, 37
Lowndes Square, London SW1X 9JL, England or by fax on +
44 (0)207 823 22 55 or email at reservations@villasofmorocco.com
making sure you quote your booking reference number. The
effective date of cancellation is the date on which written
notification is received by us or upon the expiry of the
relevant period for payment in full or part of the Invoice.
We will levy the following cancellation charges:
More than 6 weeks: 30% of total cost; (50% for peak periods)
Less than 6 weeks: 100% of total cost.
If you cancel within 6 weeks of departure, whether this
is at your initiative or because you failed to pay the outstanding
balance or if we cancel the booking due to non-payment by
you, we shall be entitled to the full cost from you.
7. CANCELLATION OF CONCIERGE SERVICES.
For all arrangements made by the Concierge on your behalf,
any cancellation less than one week in advance (or any insufficient
attendance to the service you have booked) will require
a full payment to the service provider.
8. AMENDMENTS BY YOU Upon receipt
of the Invoice please check the details to make sure they
are correct. If you have any query, please contact us immediately.
If after your booking has been accepted you require us to
amend it in any way, we will do our best to help but cannot
guarantee that it will be possible to effect the change.
If we can meet your request, we reserve the right to charge
an amendment fee of US$ 100 per booking. We reserve the
right to treat a change of villa and/or holiday dates as
a cancellation of one holiday and the booking of another.
9. INFORMATION While we make
every effort to ensure that photographs and descriptions
supplied by villa owners are accurately reproduced (in our
brochure or on our website), we cannot accept responsibility
for errors contained therein or the results thereof. By
accepting these terms and conditions, you accept that minor
differences between the photograph/illustration/text used
and the actual villa may arise. Villa owners reserve the
right to make modifications to the property specification
that are considered necessary in the light of operating
requirements. In the interests of continued improvement,
villa owners reserve the right to alter furniture, fittings,
amenities, facilities or any part of any amenities either
advertised or previously available, without prior notice.
If material
changes occur after your booking has been confirmed we will
advise you if there is time before departure.
10. REGISTRATION. All guests
must be registered at the time of the booking confirmation.
The full names and details of all guests who will be staying
in the villa must be supplied to us at the time of the booking
confirmation. For security purposes, identification will
be requested for each guest arriving at the villa.
11. ACCESS The villa owner and/or
his/her staff and representatives shall be allowed access
to the villa at any reasonable time during any holiday occupancy
for the purposes of inspection, maintenance and/or organisation
purposes should the owner be involved at villa management
level.
12. ARRIVAL AND DEPARTURE you
should arrive after 2 pm on the holiday start date, and
the villa must be vacated by 10 a.m. on the last day, to
allow some time to prepare it for the next guest. If these
times are inconvenient please advise us at the time of booking.
If the villa is not being occupied by guests on the day
of your departure, you may be able to vacate at 2 p.m. You
should make enquiries with us. If your arrival is delayed
you must inform us so that suitable arrangements can be
made, as your chauffeur will be waiting at the airport of
your arrival to pick you up and take you to your villa.
If you plan to arrive after 7pm you should notify us at
the time of booking.
13. PETS Pets are not allowed
without prior written permission. You may be asked for an
additional security deposit.
14. YOUR RESPONSIBILITIES You
and your guests are asked to treat the villa and its staff
and all furniture, fittings, effects, facilities and equipment
with care and respect and to leave it in the same state
of cleanliness and general order in which it was found.
You are responsible for all damage or loss that occurs to
the villa or its contents during your occupation, and will
be responsible for paying appropriate compensation in the
event of breakages or damage.
15. CLAIMS AND REFUNDS In the
unlikely event that you are disappointed with the villa,
you must first contact us to solve the problem. If after
that you still feel that the problem has not been resolved
to your reasonable satisfaction you should within 7 days
of returning from holiday, put your comments in writing
to us. Except from verifiable extenuating circumstances,
refunds are not made for missed services.
16. LIABILITY To the fullest
extent permitted by the law, we shall not be responsible
for any loss or damage nor for the death of or personal
injury to you or any guest or other person at the villa
unless this results from the proven negligence of ourselves,
or our employees. It should be pointed out that in some
foreign countries the general standard of care, hygiene,
safety and public services might differ from those in Europe
and the US. Consequently, for your own protection, you should
take care with what you eat and drink while abroad. We shall
not be liable for any loss, breach or delay due to any cause
beyond our reasonable control including though not limited
to act of God, explosion, flood, tempest, fire or accident,
war or threat of war, civil disturbance, acts, restrictions,
regulations, bye-laws, or measures of any kind on the part
of any governmental or local authority, strikes, lock-outs,
or other industrial actions or disputes or adverse weather
conditions. In any such case we shall be entitled to treat
the contract as discharged. In the event of such discharge
our liability shall be limited to the return of sums paid
to us in respect of the unused portion of the holiday calculated
on a pro rata daily basis less an administrative charge
of US$ 100 to cover our reasonable expenses. We cannot be
held responsible for breakdown of mechanical equipment such
as pumps, boilers, swimming pool filtration systems etc,
nor for failure of public utilities such as water, gas,
telephone and electricity. Neither we nor the villa owner
is responsible for any noise, smell or disturbance originating
beyond the boundaries of the villa or which is beyond our
control.
17. BEHAVIOUR You are responsible
for the correct and decent behaviour of your party. Should
you and your party not behave in such a manner we may in
our absolute discretion refuse to allow you (and/or any
member of your party) access to the villa or ask you (and/or
any member of your party) to vacate the villa without a
refund of the price. Villas of Morocco is committed to abide
by Moroccan law and will in particular make every effort
to help enforcing the local anti-prostitution law and regulations.
18. STAFF If you wish us to arrange
extra staff, we will do so on your behalf to facilitate
the organisation of your stay, however please note that
extra staff are under your responsibility and not Villas
of Morocco's. We also may experience sometimes difficulties
in finding the staff you requested or we may be subject
to a last minute cancellation from the staff. Should we
be in such a position, we will inform you as soon as possible,
and reimburse the full amount upon your return. Please note
that should you be unhappy with the staff provided to you,
we will try to propose a replacement, but cannot guarantee
the replacement or reimburse you. Although Villas of Morocco
chooses extra staff on your behalf very carefully, and in
particular as regards to nannies, Villas of Morocco does
not take any responsibility for any problem due to the negligence
of the staff. You are also responsible for organizing live-in
staff catering. Should you experience any problem during

19. SWIMMING POOLS Swimming pools
may not be open all year. If your stay is outside the period
1st June to 30th September, please check with us that the
pool is open. If pool heating is required an additional
charge may be payable locally.
20. PHOTOGRAPHY Photographs taken
at our villas cannot be used or sold for profit without
prior authorisation from us.
21. SECURITY AND VALUABLES Any
valuables left at the property are left at your own risk.
Neither Villas of Morocco Limited nor our agents are responsible
for their loss. All our properties are prestigious and as
with all luxury properties in prime locations, there may
be a risk of burglary. Where provided, burglar alarms must
be activated, safes used and proper care taken against theft
and burglary. We accept no responsibility for any loss,
damage or consequential losses due to theft or any other
security related incident howsoever caused.
22. INSURANCE It is a condition
of booking that you and your party have all necessary passports
and visas if necessary to travel and that each person is
covered by a comprehensive policy of travel insurance which
includes cover for accidents, medical expenses and cancellation.
23. LOW SLUNG CARS People intending
to take a sports or low slung car on holiday are advised
to check whether the access to the property allows for such
a car.
24. LAW All contractual obligations
arising out of these booking conditions shall be deemed
to come into existence in England and be subject to English
law and the jurisdiction of the English courts.
